Privacy Policy & Terms & Conditions

This privacy policy & terms & conditions of use of data, henceforth to be refered as Policy will help the users understand how Sarvayogam Solar Private Limited ("us", "we", "our") uses and protects the data provided by the user when they visit and use our website or landing page hosted on www.sarvayogamgroup.com or www.sarvayogamgroup.in.

User is defined as an individual who accesses our website or landing page hosted on www.sarvayogamgroup.com or www.sarvayogamgroup.in. The access to the website could be direct landing via links on internet browser, via third party apps wherein Sarvayogam Solar has published advertisements or provided backlinks to the domains mentioned via content or comments or any other modes.

  • By registering at our website or filling the form, the user authorizes us to contact the user via Call/ email/ Whatsapp or SMS. The contact approach shall be about making an offer regarding Solar PV System for the user’s residence/ common facility for residential building/ commercial or industrial facility.

  • The contact approach may include any or all of the following but not limited to details about our Solar Services, sharing our solar product knowledge, informing about various promotional offers and best deals in Solar Services. It is iterative that the user authorizes Sarvayogam Solar or their staff members to contact the user irrespective of the fact if also the user has registered himself/ herself under DND or DNC or NCPR service for the above mentioned communication process.

  • Sarvayogam Solar Private Limited hereafter referred by our registered brand name Sarvayogam Solar is commits to maintaining the privacy and security of the information received from any internet user on our website www.sarvayogamgroup.com or www.sarvayogamgroup.in. or any other domains which shall be registered or used in future, and which shall be updated in this privacy policy.

  • The privacy policy is created to explain the collection and usage of data from registered users via form or otherwise via direct contact from Contact Us page, using contact numbers, email ID or personal visit to office at the mentioned address.

  • By accessing or using our website/ landing page, it is imperative that the user has read, understood and agrees to be bound by this Privacy Policy. The Privacy Policy applies to collecting information globally and is not restricted to any region, country or city.

  • That the user’s access, viewing of the website and use of the website following any such change constitutes the user agreement to follow and be bound by this Privacy Policy, as updated or modified by Sarvayogam Solar.   • Sarvayogam Solar reserves the right to update or modify this Privacy Policy at any time without prior notice and such changes shall be effective immediately upon posting the updated or modified Privacy Policy on the Website/ landing page and Sarvayogam Solar shall not be bound to inform the user of any modifications hereof.

  • As per the requirements of management, Sarvayogam Solar may offer specific campaigns, online or offline activities or events that can have additional specific terms of privacy policy/ notifications or may require consent from the user. In such cases the information will be processed as per the new set of conditions of the privacy policy, which otherwise may be mentioned. It is advised to the users to read the terms and conditions before interacting or participation in such events or availing such offers or activities.

  • Sarvayogam Solar has all the rights to collect personal information of the visitor including but not limited to name, city of residence, pin code, gender, age, date of birth, mobile number, electricity usage details, address of premises etc., type of device used by the user, the domain server through which the User accesses the Website and the functions and features therein, IP address, browsing history, email address, interests & preferences, data profile regarding online behaviour and purchasing behaviour, previous interactions with Sarvayogam Solar & likes.

  • Sarvayogam Solar would like to clarify that the collected information shall be processed by Sarvayogam Solar for promotional purposes like calling the user, sending promotional messages, SMS, videos, images or any kind of written or audio content for canvassing of our brand viz Sarvayogam Solar. It may include adding the user’s communication number in our broadcast list/ whatsapp groups etc or invitation to webinars/ offline events/ contests or likes.

  • Sarvayogam Solar may share the user information within the Sarvayogam group companies. We shall not rent, sell or share User information and shall not disclose any of the User’s Personal Information to third parties. Service Providers may include analysis firms, advertisers, payment processing companies, customer service and support providers, email, IT services and SMS vendors, web hosting and development companies and fulfilment companies. However, Sarvayogam Solar may be forced to share the information if this helps to investigate, prevent or take action regarding unlawful and illegal activities; suspected fraud, potential threat to the safety or security of any person, violations of Sarvayogam Solar’s terms and conditions or as defence against legal claims.

  • Sarvayogam Solar has all the legal rights to defend itself in case of litigations and investigations/ legal suits/ cases/ suo moto etc involving any disputes arising out of usage of our website or landing page and in case of such legal actions, the court of jurisdiction shall be Surat.

  • In case Sarvayogam Solar Private limited is sold partly or fully, or is divested territory wise via share dilution or any other external agreement, the user information may be transferred to the buyer. Sarvayogam Solar reserves the rights to disclose user information to respond to authorized information requests from government authorities, to respond to valid judicial requests, to address national security situations, to provide security and investigate potential fraud, or when otherwise required by applicable law.

  • Users’ rights: Users have choice of not filling the form, however which may prevent them from receiving the offers and details pertaining to solar system, which in itself is the purpose of their visit to Sarvayogam Solar’s website or landing page. Users also can de-register from our SMS or whatsapp messages by informing via same channel. For any assistance, the user may write to us over info@sarvayogamgroup.com regarding any problems or issues pertaining to user experience, data misuse or maintaining their privacy. The user can expect a reply from Sarvayogam’s management within 72 working hours from the receipt of the email & get acknowledgement. Any further course of action can be decided based on severity of the issue and the urgency created by the same. Sarvayogam Solar will try to resolve such issues within 15 working days from the date of complaint.

  • It is to be noted that the use of website is not for minors. The Website should only be used or accessed by persons who are competent to enter into a legally binding contract under the Indian Contract, 1872. If the user is minor (i.e. under the age of 18 years), the user may use the Website only with the involvement of parent or guardian.   • Sarvayogam Solar shall periodically inform its Users, at least once every year, that in case of non-compliance with this Privacy Policy, it has the right to terminate the access or usage rights of the Users to the Website immediately or remove non-compliant information or both, as the case may be.

  • Please note that this policy is in accordance with the Information Technology Act, 2000 (“IT Act”) and rules thereunder. Rule 4(1) of the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 (“Data Protection Rules”) requires body corporates to have a privacy policy in place and published on its website. The consent for use/processing of the SPDI is usually obtained by having such person accept the terms of the body corporate’s privacy policy.

  • Rule 3 of the Data Protection Rules defines sensitive personal data or information (“SPDI”) of a person to mean such personal information which consists of information relating to (i) password; (ii) financial information such as bank account or credit card or debit card or other payment instrument details; (iii) physical, physiological and mental health condition; (iv) sexual orientation; (v) medical records and history; (vi) biometric information. Thus, a person’s personal information, such as medical history and physiological conditions, are considered SPDI under the Data Protection Rules. When a body corporate (i.e. any company and includes a firm, sole proprietorship or other association of individuals engaged in commercial or professional activities, per Section 43A of the IT Act) collects, stores, transfers or processes such information, certain requirements under the Data Protection Rules are triggered.

  • Rule 5(3) of the Data Protection Rules provides that while collecting information directly from the person concerned, the body corporate or any person on its behalf shall take such steps as are, in the circumstances, reasonable to ensure that the person concerned is having the knowledge of (a) the fact that the information is being collected; (b) the purpose for which the information is being collected; (c) the intended recipients of the information; and (d) the name and address of (i) the agency that is collecting the information; and (ii) the agency that will retain the information. Request the company to please confirm if this information is collected and its purpose.

  • Rule 5(5) of the Data Protection Rules provides that the information collected shall be used for the purpose for which it has been collected.

  • Rule 7 of the Data Protection Rules provides that a body may transfer SPDI to any other body corporate or a person in India, or located in any other country, that ensures the same level of data protection that is adhered to by the body corporate as provided for under these rules. The transfer may be allowed only if it is necessary for the performance of the lawful contract between the body corporate and provider of information or where such person has consented to data transfer.

  • This is in accordance with Rule 3 (1) (h) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 (“Intermediary Rules”). There are requirements such as allowing users to opt-out (Rule 5(7) of the Data Protection Rules) or modify (Rule 5(7) of the Data Protection Rules) their SPDI if required.

  • The Data Protection Rules also mandate the implementation of reasonable security practices and procedures in order to keep the SPDI secure. This requirement is fulfilled if the body corporate conforms to the international standard IS/ISO/IEC 27001 on “Information Technology – Security Techniques – Information Security Management System – Requirements” or similar standards that are approved and notified by the Central Government. As on date, no such standards have been notified. There is a requirement to appoint a ‘Grievance Officer’ (Rule 5(9) of the Data Protection Rules), whose contact details are to be published on the website.
